JASON VAN DYKE GETS PALTRY 6 YEARS 9 MONTHS FOR MURDER OF LAQUAN McDONALD

     The former Chicago police officer convicted in the murder of a black teenager who was shot 16 times as he walked away was sentenced Friday to 6 years, 9 months.
    Jason Van Dyke's punishment was far less than the minimum of 18 years that prosecutors were seeking, although state sentencing guidelines allowed for as many as 96 years or more — the equivalent of six years served consecutively for each shot.
     He will also have to serve a two-year mandatory supervised release after his prison term.

The cops accused of helping Van Dyke cover up his crime got off altogether via decision by a judge.  However, this conviction may make the first time in decades that a police officer in Chicago has gone to jail for anything he did while on duty. As I recall, when Dante Servin was on trial for shooting Rekia Boyd, it had been 17 years since a cop had seen the inside of a Chicago courtroom as a defendant. 

This is a step in the right direction. But I'd planned on being happier. I'd planned on Van Dyke getting 18 years and his cronies getting a year or two each.

But this is a step in the right direction.

What the people of Chicago need to do now, is hold the judges accountable come election time. And the voters of Chicago need to correct the law where a judge, instead of a jury, gets to decide the guilt of a cop. Police officers should not be able to opt for a judge's decision rather than a jury's. 

The jury decision have not been going our black-live-matter way very often. But I suspect the judge decision trials are going our way about one-tenth as often -- which why cops opt for them so much.

ON THE HEELS OF SURVIVING R KELLY DOC CYNTOIA BROWN IS GRANTED CLEMENCY

    A woman who...was a 16-year-old sex trafficking victim when she killed a man in 2004 was granted clemency Monday by Tennessee's governor and will be released from prison.

     Tennessee Gov. Bill Haslam granted clemency Monday to Cyntoia Brown, who had been serving a life sentence but who will be released on parole on Aug. 7.
     "Cyntoia Brown committed, by her own admission, a horrific crime at the age of 16. Yet, imposing a life sentence on a juvenile that would require her to serve at least 51 years before even being eligible for parole consideration is too harsh, especially in light of the extraordinary steps Ms. Brown has taken to rebuild her life," Haslam said in his statement.
     Brown will remain on parole supervision for 10 years on the condition she does not violate any state or federal laws, holds a job, and participates in regular counseling sessions. She is now 30 years old...

Cyntoia's Clemency and SURVIVING R KELLY might not be tied together in any way. But I am certain all the talk about men using children for sex, generated by the the R. Kelly documentary on Lifetime didn't hurt.

Black feminists, and other feminists, keeping track of her case and raising her case up was probably one of the keys to her release.

TRUST BLACK WOMEN TO TAKE OUT MIKE BROWN'S COP PROTECTING WHITE PROSECUTOR ON ELECTION NIGHT

Prosecutor Bob McCullough, who did as much to protect Darren Wilson after he murdered Mike Brown as his defense attorney did, was voted out of a job last night. He’s the third prosecutor, that I can think of off the top of my head to get HIS head handed to him on election night thanks to black women. Only this time, black women put a black person, Wesley Bell, in the white man’s place.

In a surprise upset Tuesday night, a Ferguson, Missouri, councilman promising criminal justice reform ousted a 28-year incumbent St. Louis County prosecutor known nationally for his decision not to file charges against the police officer who shot Michael Brown in 2014.

Wesley Bell, a 43-year-old black man, campaigned on a variety of criminal justice reform promises, including one to rid the county of cash bail for nonviolent offenders, according to the St. Louis Post-Dispatch. When he won the Democratic nomination, he essentially guaranteed he will fill the St. Louis County prosecuting attorney position, as he is running unopposed in November. 

But as much as Bell’s victory was a vote for reform, it was also a rejection of the system that allowed Darren Wilson, the officer who fired 12 bullets at teenager Michael Brown four years ago, to walk free....

Apparently, Bob’s going to retire sooner and poorer than planned. I wonder if he’s on the phone to Darren Wilson right now looking for half of that ABC Interview money. As I recall Wilson got one million dollars to show tell the public how red one his cheeks got after Brown supposedly “attacked” him.

VOTING MATTERS.

Bell doesn’t just represent a change of face. He represents a change in attitude.

For example, he wants to stop requiring cash bail for non-violent offenses. Blacks, having a higher poverty rate, were often languishing in jail for stupid stuff like unpaid parking tickets or kiting checks, while Becky – who tried to blow Chad’s head off during an argument—got to wait for her court date at home because she had access to enough money to make bail.

VOTING MATTERS

Mike Brown died 4 years ago today.  This is but a small tribute. But we are inching our way forward. We've taken out white prosecutors in Ohio and Florida over the last few years. And now some folks are calling on the Missouri governor to re-open Mike Brown's case. I hope the citizens of that state are successful because I know more now then I did at the time -- the most important part being that the police only showed us a fraction of the videos available from that store.

"The NFL and NFLPA, through recent discussions, have been working on a resolution to the anthem issue," the joint statement said.

"In order to allow this constructive dialogue to continue, we have come to a standstill agreement on the NFLPA's grievance and on the NFL's anthem policy," it said. "No new rules relating to the anthem will be issued or enforced for the next several weeks while these confidential discussions are ongoing."

Magnolia Oakland dispensary, a company that provides adults with medicine with cannabis, posted a statement on Instagram announcing its decision to discontinue the sale of TreatWell's products hours after the incident. Since then, several other weed dispensaries have severed ties with Ettel's business according to VICE.

The statues are now among the traitors they represented. And the white people who want to visit those who fought to keep this country divided and keep slavery in place will likely be the only ones who will see them from this point forwarded.

As the sun set Tuesday on a beautiful fall day, it also set on Lexington’s two most visible symbols of history rewritten.

• A bronze statue of John C. Breckinridge, a former U.S. vice president whose last public role was as the Confederate Secretary of War, had stood in a place of honor in Lexington’s public square since 1887. More than two decades after the Civil War ended, the United Daughters of the Confederacy placed it there and persuaded Kentucky legislators that it was a good use of $10,000 of taxpayer money.
• Confederate Gen. John Hunt Morgan, a cavalry raider who burned towns and stole horses, was honored nearby with a bronze equestrian statue in 1911, nearly five decades after the Civil War ended. When the memorial group could raise only half the statue’s $15,000 cost, state officials used taxpayer money for the other half.

In both cases, black citizens were not asked their opinions. These statues were all about showing them who was still boss.

The Morgan and Breckinridge statues were among dozens erected around the South during Jim Crow era. The goal was to recast the image of a rebellion to destroy the Union and preserve slavery as a noble “lost cause” of Southern culture and pride.

Those monuments endured for more than a century, but they have begun coming down across the South because they can no longer be explained away as benign artifacts. Modern white supremacists, who have friends in high places, rally around them as hateful symbols of “heritage.” A deadly protest over removal of a Confederate statue in Charlottesville, Va., spurred Mayor Jim Gray and the Urban County Council to action.

Black Lives Matter has raised awareness of these statues and race issues in general. Other groups have taken up the cause of pushing back against white racists and white supremacy enablers as a result. And this should be considered a victory because these statues were put up right after the civil war, the message to black people being "you're still nothing and we, the white people, are still in charge"

Southern whites made good on that threat and northern whites followed suit in many ways.

"JUAN GONZÁLEZ: We begin today’s show in Durham, North Carolina, where a crowd of activists toppled a Confederate statue in Durham on Monday, just two days after the deadly white nationalist rally in Charlottesville, Virginia. The crowd of activists shouted "We are the revolution," as a college student named Takiyah Thompson climbed up a ladder, looped [a rope] around the top of the Confederate Soldiers Monument in front of the old Durham County Courthouse and then pulled the statue to the ground as the crowd erupted in cheers.

PROTESTERS: We are the revolution! No cops, no KKK, no fascist U.S.A.! No cops, no KKK, no fascist U.S.A.!

AMY GOODMAN: On Tuesday, Takiyah Thompson was arrested on two charges of felony inciting a riot and three misdemeanor charges—injury to personal property, injury to real property and defacing a statue. She spoke in Durham just before she was arrested.

TAKIYAH THOMPSON:  

I think what we did was the best way, and not just the best way, but the only way, because the state and the Klan and white supremacists have been collaborating. Right? So what we did, not only was it right, it was just. I did the right thing. Everyone who was there, the people did the right thing. And the people will continue to keep making the right choices until every Confederate statue is gone, until white supremacy is gone. 

That statute is where it belongs, right? It needs to be in the garbage, incinerated, like every statue—every Confederate statue and every vestige of white supremacy has to go.

AMY GOODMAN: Takiyah Thompson, speaking in Durham, North Carolina. Shortly after she spoke, she was arrested, given a $10,000 unsecured bond. She was released last night, heads to court this morning. But just before she does, she joins us here on Democracy Now! Takiyah Thompson is a student at North Carolina Central University and a member of Workers World Party, Durham branch.

Welcome to Democracy Now!, Takiyah. I know you’re under enormous pressure as you head to court for—after being arrested for climbing a ladder, looping a rope around the top of the Confederate Soldiers Monument and pulling down the statue. Talk about why you engaged in this, and exactly what you did.

TAKIYAH THOMPSON: 

 OK. I participated in a march and a rally. And I decided to climb to the top of the Confederate soldiers statue and put the rope around its neck and throw the rope down to the crowd. And the crowd could decide if they wanted to pull it down or not. And I did this because the statue is a symbol of nationalism, and it’s a symbol of white nationalism.

And the type of white nationalism I’m talking about is the type of white nationalism that is sending me death threats on Facebook. 

I’m talking about the type of white nationalist that, you know, has killed a woman in a protest. 

We’re talking about the type of white nationalism that would drive a car at high speeds into a crowd of women and children. 

And I think vestiges of that, and I think anything that emboldens those people and anything that gives those people pride, needs to be crushed in the same way that they want to crush black people and the other groups that they target.

OBAMA APPOINTED JUDGE DENIES DOJ JEFF SESSIONS REQUEST TO DELAY CHANGES TO BALTIMORE POLICE

It orders more training for police on de-escalation tactics and interactions with youths, those with mental illness and protesters, as well as more supervision for officers.

The deal also requires the city to invest in better technology and equipment, and for the Police Department to enhance civilian oversight and transparency...

TRAYVON STILL FUELS A MOVEMENT FIVE YEARS LATER

Exactly a month after Trayvon Martin was killed, his family gathered in a muggy back room at the civic center in Sanford, Florida. The city council was preparing for its first public meeting since the boy's death, and his family and their supporters wanted to pressure city leaders to step up and arrest the man who had fatally shot Martin.

Outside of the civic center a crowd of thousands began to swell, chanting so loudly that at times it felt like a train was rumbling in the near distance. For weeks, momentum had been building around the call for justice for Martin, the 17-year-old whose life was taken by George Zimmerman, then a neighborhood watch volunteer.

But inside the room that evening, away from the cameras, away from the hounding media and the emotional protests whipping up just yards away, there was an intimacy — a rare quiet moment amid the profound anger that was beginning to spill from that small Florida city to cities all across America.

"We can't stop," Tracy Martin, Trayvon's father said at the time. "If we stop, the world will stop. We've got to keep fighting."

In Martin's death, a movement was born.

Broncos linebacker Brandon Marshall said he expected pushback. He knew not everyone would agree with his decision to kneel for the national anthem before the Broncos’ season opener against Carolina on Thursday evening.

 

He expected some to perceive his protest, designed to highlight issues such as racial inequality and police brutality, in a negative light.

Friday morning, his expectation became reality when Air Academy Federal Credit Union released him from his endorsement deal. Marshall became AAFCU’s official spokesperson in May.

Two weeks after San Francisco 49ers quarterback Colin Kaepernick’s national anthem sitdown grabbed headlines, the Seattle Seahawks could be ready to join him.

Seahawks defensive back Jeremy Lane has already done so. Lane sat down during the national anthem before Seattle’s final preseason game against the Oakland Raiders last week. But now, it seems the entire Seahawks team is planning something during their season opener against the Miami Dolphins on Sunday. What that something is, though, remains unclear.

KAEPERNICK VICTORY: 49ers PLEDGE 1 MILLION TO FIGHT RACIAL INJUSTICE

The 49ers on Thursday pledged $1 million toward two Bay Area groups that address the type of social inequities and racial issues their quarterback, Colin Kaepernick, has spotlighted in recent weeks.

The groups are the Silicon Valley Community Foundation and the San Francisco Foundation.

 In a statement, CEO Jed York said the financial commitment is meant to improve “racial and economic inequality and fostering communication and collaboration between law enforcement and the communities they serve here in the Bay Area.”

Of course the BLM movement has raised the awareness of non-black people. Black people were mostly already aware but BLM has raised the courage of black people. Background:  In case you've been living under a rock. Two black people have faced loud white criticism for not standing or saluting during the national anthem.

The first was Gabby Douglas, who looked to me like she just zoned out and wasn't paying attention during the Olympics. The national anthem will do that to the average person. And you'll never convince me that a larger percentage of the white population knows that when the person who zones out is white.

And now, as of last week, one of the 49ers Quarterbacks  (who is auditioning to become the main quarterback) Colin Kaepernick, deliberately refused to stand for the National Anthem during a NFL pre-season game.

When questioned he said he would not "show pride in a flag for a country that oppresses black people and people of color.

And just in case you think Kaepernick was just started riffing about racism because he got caught napping too, just listen to this one minute clip of an interview.

It presents a particularly fraught dynamic for sports stars, since sports events are often so closely tied with the rhetoric of American pride. When a highly visible opinion comes up against a highly visible symbol, the result is always incendiary.

1968 Olympics

Around the same time, Jackie Robinson was using his achievements to advance Civil Rights causes, two American Olympic runners, Tommie Smith and John Carlos raised their fists in a black power salute during a medal ceremony at the 1968 Olympics in Mexico City as the anthem was playing.

The result was iconic. The reaction was ugly. Racial slurs were hurled at the pair [by white people] and an article in [the white run magazine,] TIME, called it a “public display of petulance.”

Today, similar criticisms have been leveled against Kaepernick [predominantly by white people], a biracial Super Bowl quarterback who was raised by white adoptive parents and made $13 million in 2014. He was called “spoiled.” He was called far worse [predominantly by white people] in his Twitter mentions.

When a Chicago judge dismissed the charges against Police Officer Dante Servin for the death of Rekia Boyd when Servin...

- shot her over his shoulder
- killed her while off duty, 
- with an unregistered weapon, 
- over what began as a noise complaint

The judge stated that the reason for the dismissal was that the prosecutor, Anita Alvarez, presented murder evidence that did NOT match her manslaughter charge.  At the time of this judicial fiasco, Chicago hadn't prosecuted a police officer in at least 17 years.

Later, Alvarez would state that she struggled with whether Servin should be charged at all

Obviously, Prosecutor Anita Alvarez's hadn't heard that

CLEVELAND PROSECUTOR VOTED OUT OF A JOB, BLACK VOTES MATTER

Timothy McGinty WAS the Cleveland prosecutor that failed to get a conviction of Officer Michael Brelo.

You may not remember Brelo's name. But you probably remember hearing about him standing on the hood of car and firing no less than 3 dozen bullets down into two unarmed people, Malissa Williams and Timothy Russell over what sounds like a car backfiring.

He and cops on the scene were so scared of the sound that they fired a total of 137 bullets into these two black people.   

And then a judge dismissed the case against Brelo.

Whether McGinty flubbed the case or not, McGinty did file an appeal of the Michael Brelo decision. However, as others in the main stream media have pointed out, McGinty knew that double jeopardy applied and that this would prevent his appeal from changing the reality that Brelo was not going to see the inside of a jail cell.

How does one fail to get a conviction in case like this? Judge or no judge, is it even possible to fail at appealing it when cops fire 137 bullets over a misfiring car sound in the distance? And Brelo stood on top of the car and fired down into it--- clearly indicating he was NOT afraid of anything, as exposed as he would have been....had Malissa or Timothy been armed.

Timothy McGinty is also the prosecutor who declined to file charges against Frank Garmack and Timothy Loehmann, the incompetent police officer that murdered Tamir Rice seconds after arriving on the scene of a playground.

McGinty was one of those that said Rice looked like an adult, like he was trying to make the defense attorney's case.

Last month, Cuyahoga County Prosecutor Timothy J. McGinty's office on Wednesday announced that the Ohio Attorney General's Office will take over the investigation into the Cleveland police killing of Tanisha Anderson.

Black folks vowed they wouldn't forget that McGinty doesn't appear to believe that Black Lives Matter, and they didn't.

Black folks turned out in force to vote on Super Tuesday, proving Black Votes Matter too. Timothy McGinty conceded defeat to Michael O'Malley with only 89% of the precincts counted.
